USA Swimming Will Not Ratify American Records Set after October 1st in Tech Suits

As was first reported yesterday by Swimming World Magazine on their website, a USA-Swimming official has said that American Records set after the October 1st, 2009 deadline for USA-Swimming will not if they were swum in Tech Suits.

This has caused a minor uproar given that FINA will not outlaw the full-body polyurethane suits until Januray 1st, 2010. This will leave certain records in an awkward position where World Records held by American swimmers will actually be faster than the corresponding American Record.

Swimming World Magazine first researched this issue when several of their readers inquired as to whether or not records set at this weekend's Duel in the Pool, which was swum in the U.K where the old suits were allowed, would stand as American Records given that USA-Swimming had already banned the suits. In addition to the 10 World Records that were set at the Duel in the Pool, there were also 5 more set in the FINA World Cup, which had 5 meets that all took place after October 1st.

The original article speculates that "The sport could potentially see some lawsuits from this ruling as swimmers who were competing legally in an event at the time could be denied bonus money with USA Swimming not ratifying a national record" but there has been no indication that any swimmer intends to do so.
